Ensuring that Crown and statutory duties to consult Aboriginal communities have been satisfied involves complex analysis of the scope of the proposed project, the First Nations, Inuit and Métis interests affected and the extent to which accommodation is warranted. Our lawyers have significant expertise in conducting such analysis for mining, infrastructure and energy projects across Canada, including assessment of existing treaty rights, asserted land claims or claims regarding traditional use. We are experts at conducting Aboriginal-related due diligence for investors and lenders. We also have extensive experience advising businesses and industries on developments on reserve lands.

We advise on accommodation required as a result of Aboriginal consultations, including the negotiation of impacts and benefits agreements. Whether negotiating equity arrangements or developing training and employment programs, we are strong advocates for project developers while ensuring that Aboriginal interests are appropriately recognized.
