The Davies Competition & Foreign Investment Review group is a recognized leader in guiding foreign clients through the Canadian political landscape and advising domestic and international clients on the application of the Investment Canada Act ("ICA") and foreign ownership restrictions in the telecommunications and broadcasting sectors. We have represented clients in some of the largest and most complex foreign investment and foreign ownership reviews undertaken and have extensive experience in all aspects of foreign investment review, providing strategic advice on matters before the Investment Review Division ("IRD") of Industry Canada and, for transactions involving cultural matters, the Department of Canadian Heritage, as well as the Canadian Radio-television and Telecommunications Commission for transactions involving the telecommunications and broadcasting sectors.
Our lawyers also assist clients in less visible ways, helping them to navigate the legal/regulatory context in which they operate. In addition to securing approvals under the ICA, our lawyers assist clients in establishing to the satisfaction of the IRD that the ICA does not apply to a transaction. In the telecommunications and broadcasting sectors the team is able to deliver sound cross-disciplinary legal and business advice as new business models emerge recognizing that in Canada a complex interplay exists between cultural policies, industry regulation, innovation, convergence and the dynamic nature of today's rapidly evolving Internet-based economy.
